Legal Agreement Form

The Parties herein agree as follows:

 

ANPSS and Client each may terminate this contract at any time by written notice to the other.  ANPSS will be entitled to payment for all services rendered until notice of termination is received, and for any transition services reasonably required to provide for health and welfare of Client’s pet.  ANPSS will not terminate during a period of scheduled service unless ANPSS determines, in its sole discretion, that a danger exists to the health or safety of ANPSS.  If such concerns preclude ANPSS from providing further care of Client’s pet, Client authorizes pet to be placed in a kennel, with all charges incurred to be charged to Client.  Every attempt will be made to notify Client regarding such situation.

(herein known as Client) and Aunt Nancy’s Pet Sitting Service and its employees (herein known as ANPSS), and will remain in effect until terminated by either party. 

Client may make telephone reservations for additional service at any time during the term of this contract, subject to ANPSS availability.  All scheduled visits will be governed by all of the terms of this contract.

 

In the event of inclement weather or natural disaster, ANPSS is entrusted to use best judgment in caring for pet and home.  ANPSS will be held harmless for consequences related to such decisions.

 

ANPSS agrees to provide the services stated in this contract in a reliable, caring and trustworthy manner.  In consideration of these services and as an express condition thereof, Client expressly waives and relinquishes any and all claims against ANPSS except those arising from negligence or willful misconduct on the part of ANPSS.

 

Client acknowledges that payment is due immediately upon completion of a scheduled service without further invoice or notice.  A handling fee of $20.00 will be charged on all returned checks.  A fifty percent (50%) deposit is required on lengthy assignments.  First-time Clients or Clients with a history of late payment will be required to pay in advance before services are rendered.  In the event it is necessary to initiate collection proceedings on the account, Client will be responsible for all attorney’s fees and costs of collection.

 

In the event of a personal emergency or illness of ANPSS, Client authorizes ANPSS to arrange for another qualified person to fulfill responsibilities as set forth on this contract.  Every attempt will be made to notify Client regarding such situation.

 

Client understands that all pets must have a veterinarian and that all pets are to be currently vaccinated.  Should ANPSS be bitten or otherwise exposed to any disease or other ailment received from Client’s pet, it is Client’s responsibility to pay all costs and damages incurred by ANPSS.  Client understands that all dogs must possess and dog license firmly affixed to the pet’s collar.

 

ANPSS will not be held responsible for damage to Client’s home beyond the control of ANPSS.  This includes, but is not limited to leaks, electrical problems, and acts of nature.  If Client is unable to be reached in any of these situations, ANPSS will take action to rectify the situation and will not be held responsible for consequences related to such action.

 

ANPSS is not responsible for wilted, dead or otherwise unhealthy plants.  ANPSS will work hard to follow your written instructions as precisely as possible, but cannot be responsible if the results are not favorable.  Please place all indoor plants together on a waterproof surface in plain sight, as ANPSS is not responsible for water damaged areas or missed plants.

 

ANPSS reserves the right to deny service due to concerns over pet sitter safety, or inappropriate or uncomfortable situations.

 

Client agrees to inform ANPSS of pets with biting and aggressive behavior.  ANPSS reserves the right to decline service in these cases.

 

All pets must be walked on a leash, without exception.

 

Client agrees to supply all necessary supplies and equipment for the care of their pets, including, but not limited to pet collars, identification and vaccination tags, leash for walks, cat litter boxes and cat litter, pet food, cleaning supplies, “pooper scooper” for dogs and cats, and pet medicine.  Client authorizes purchases for any supplies needed.  Reimbursement to ANPSS will be included in final invoice upon Client’s return home.

 

Pets with electronic fences must wear their collars with fresh batteries at all times.  ANPSS will not be held responsible for pets that roam beyond electronic fence perimeter.

 

Client is responsible for making arrangements for snow removal in their absence.  ANPSS reserves the right to deny service should snow conditions create unsafe entry and exit from Client’s home.

 

ANPSS visit schedule revolves around a two to three hour window of time up to three times per day.  ANPSS will not conduct time specific visits, but will do its utmost to adhere to the visit schedule agreed upon between Client and ANPSS. 

 

Client agrees to secure their home prior to leaving the premises.  ANPSS shall re-secure the home to the best of its ability at the end of each visit.  ANPSS shall not accept responsibility for the security of Client’s home if other individuals have access to Client’s home during the Client’s absence.

 

ANPSS will not provide service to a home with visiting pets that do not belong to the Client.

 

Client agrees to notify ANPSS of any concerns with service provided by ANPSS within 24 hours of Client’s return home.

 

I have reviewed this contract in its entirety.  The information provided by me is complete and accurate and I agree to all its terms and conditions as set forth above.
